Technically no, simply because the work isn't all theirs to begin with. The designer doesn't own the artwork, so has no rights to edit it and call it their own and then sell it on. The real problem lies in the fact that if the artwork changes a lot, then you'd never know. In this instance, we know the artist used that vector to begin with. If we didn't know any better, you'd struggle to say that it was a copy or violation based on how it looks now.

Regardless of that not being CMYK. Why the hell has the designer done that on the preview? You can't even see the logo properly. I like the thinking behind the design, but it's let down totally by lack of thought in the presentation. Why not just use the extra preview uploads as an option?

Monogram, arrow, negative space? His submition doesn't even have descrption. And with a reason - it can be found on my design's page. This design has been discussed before for getting caught with design too similar to others breaking the line of just inspiration.

But the tire on the winner logo does not match that particular iStock illustration. Here's a side-by-side comparison with a color modification of the iStock illustration: http://img86.xooimage.com/files/a/0/7/no-match-3686fd8.jpg

As you can see, there is no match whatsoever. Furthermore, I was not able to find other sources of the tire with Google Images or TinEye.

On the other hand, the arrows are definitely ready-made design elements and thus violate the rules.

I'm pointing this out before anyone sees this and says I'm copying. I've never seen it before and the one on the other site maybe younger than my idea.

My concern is that this designer may have copied my idea, put it to a client and obtained a copyright for it. Where would that leave me? If mine was uploaded here before the other one was created where does it leave me and the client who has copyrighted the other logo?

According to Google (using image search, past year), that designer uploaded his design to several websites (behance, creattica, studioera, etc.) between 06/18/2012 and 07/05/2012. Also, the actual company registered the domain on 04/19/2012. See http://www.ripn.net/nic/whois/en/ to submit the domain http://2metra-ufa.ru/ (without the protocol and slashes).

These were actually on purpose. Either because they we variations of the same design before the new system that now allows multiple views (these I will merge) or to stylize a design to appeal to a different buyer or price range. I'm not the only designer that does this. I don't see how it is different than have the logo up for sale on multiple sites. When one sells I have to be sure to delete all other instances.

A LOT of the bad comes out of the un-moderated contests. No QC, I feel bad for the contest holders. What do they pay for? Designers are not screened, entries and winning final files are not checked to be sure they make the basic file requirements (fonts outlines, color format, vector etc) or minimum design standards, and most moderation that is done by volunteers, except for blind contests - there's no moderation there.

You should not take it personally. You must admit that the similarities (between your logo and the shutterstock illustration) are uncanny, particularly the body of the bear (number of polygonal shapes, number and placement of "folds", proportions, placement of gradients, etc).

Even if it is a coincidence, even if we give you the benefit of the doubt, this logo can not be accepted. Remember, according to the rules, the design must be original. Also, the same rules indicate that designers must use tineye or google images to make sure there are no similar existing designs.
