This is an example of what I call "cheesy". It's not really copying, but it *looks* like it is. It's legal, and all that, but... well... it's cheesy.
When one of my logos comes out cheesy, I take it as a sign that I need to work on the idea some more. It can be hard to let go of something, especially if you thought it was a really good, original idea, but sometimes it's better for business.
Well, of course I could make an abstract diamond, I wanted something close to realistic. Anyway, I've made a lot of adjustments (adding more faceting). Hopefully it will be sufficient. Even if you look at everything you posted with a side view (not tilted), the basic concept is the same.
Still, I don't think it should have required changing, based simply on the fact of what it is.

Not really. The Sushi logo is using negative space. But splashfish doesn't seem terribly well executed or original by comparison.

Hi Tabitha, I made that comment. My point wasn't that splashfish was in itself poorly executed - I could learn a lot myself by studying your work! I was simply saying that alongside a clever and skillfully-crafted negative space logo, just about any other logo on a similar theme would look less inspired by comparison, no matter whose it was.

Look carefully, you can see a negative space shape, similar to an "S" between the two fish. Granted, it is not very obvious and the two fish may also be considered letter substitution, but there was talk about negative space in the comments when this logo was originally posted (August 2008).

I just showed both designs to my husband (also a designer). He prefers yours since he couldn't read the "S" quickly in the sushi logo.
I don't think the fact that both make an "S" out of two fish is enough to call it stealing. The looks of the designs are very different.

And I was actually on TK's side with that. It's the same argument she was pointing out before with her pen nib/curtains design but this time it's one of her designs that are in the spotlight as being too similar a concept etc. I would definitely see applex point if this is still allowed to stay on site. Just to make matters worse, this is included within the logos recently sold by TK to stocklogos. I can't see it being pulled for those reasons.
Mine was made before the sushi logo. Just wanna point that out. I uploaded the splashfish logo on Brandstack (Incspring) about 4-5 years ago. It was also uploaded on Logopond about 3 years ago (http://logopond.com/gallery/detail/61747)

The date of creation should not be your evidence. Maybe your logo was made before smartinup's logo, but this will be very hard to prove.
a) Incspring launched at the end of July 2008, that was 3 years and 5 months ago (not 4 or 5 years ago). See this page and this page. It would be hard to find the exact date of your upload since TheWayBackMachine didn't properly crawled that particular page. By the way, the domain was created at the end of March 2008.
b) The designer smartinup uploaded his logo on logopond on August 8th 2008. See this page.
Conclusion: Assuming you joined Incspring on their first week and uploaded your logo right away, then you probably created your logo several days before he created his logo. But, if you joined/uploaded after August 8th, then probably smartinup created his logo first.
For those who think the logos are similar, I say it is most probably a case of parallel evolution.

There is absolutely no comparison. These two logos look nothing alike! I don't understand why this was even flagged. Even concept-wise they are still very different.

No, we don't work by precedents, because it's impossible to compare the cases. This is grey area. I wish it wasn't up, but I leave it up to the designer. It's not damaging to us I think.

These two seem to use the same idea, but they don't look exactly alike. Though I'd say that the yellow one definitely looks more 'liony'.
I haven't a problem with this one really. It's just if Ninil wants the animal shelter one removed then this design of his should be removed on similar grounds.

You should have left it, like already has been said similar concepts are used, it's going to happen, but then that means at the same time work like the Animal Shelter and Splash Fish and probably a ton of others has to remain. I'm for the latter, I only think traces and direct copies should be removed. That's also probably the easiest way to govern it.

It's often really easy to find the cheaters. With at lot of the ones I've found, I just crop out the name of the logo and put it into a google image search. (I haven't had as much luck with tineye.)

This is an interesting one. I personally think it wouldnt be accepted on SL but the logo is on Logopond. You would have to take that up with that particular designer. How does SL stand on this though? Would they get involved and help? Or is it solely down to the designer? The other designer could simply ignore Applex. Then Applex may well sell the design on SL and the client comes across the other logo on logopond. It could look bad on SL because that client might think Applex has sold a logo that's not bespoke.

The brief does not refer to any clock, is a brief that wants a logo for a dental office that contains the number 10 in name.
That's just two different people trying to represent the number 10 in a clever way. There's nothing unusual about similar concepts showing up in briefs. I notice the second one also includes a compass pointing west.
inGenious, none of us are quite as clever and original as we like to think we are. If we start thinking that we are soooo creative that nobody could possibly think of the things we think of, we stop advancing. It's not good to get all tangled up in worrying about what other people are doing. Your *design* looks better than theirs, and that's the important thing.

The logos look very different. I don't think using a clock to symbolize the number 10 is an original idea. eMindz clock is also a compass. If both logos represented a clock and a compass at the same time, then it would be pretty iffy.

Yep, hard call alright. However, I think they are drawn different enough that it is safe to keep. Also, yours can be more symbolic, as lemon and fish are common to eat together.
I'm wondering if you had made it, say, a kiwi fish, would the question still come up? I think it's just because the only difference between a lemon and a lime is the colour. Probably best to see how the designer of the lime fish feels about it.
I actually got the idea from the name itself, "lemonfish". It's a kind of shark and it's my favourite. It does taste a bit like lemon.

It would inspiration if you took the idea of the warped shape and made a new shape from scratch using the same idea, this is a direct copy.
Copy of a geometrical shape of an image? Its not a violation to copy a shape. The violation comes when the image is already a clipart or a logo!!!! Also when it comes to geometrical shapes and their combinations there is no parthenogenesis. No one can claim that the shape exists only in that image.

Copying a not unique shape inside a photo doesn't mean that I copied the image!!! Also I made it! I didnt trace or something! Its not an exact copy!!! I copied the idea not the image. Its like making a beetle car vector! You cannot make a beetle car with a lot of ways when it comes to a specific view! Also before accusing me you can go to my portfolio and see my logos - I am not a copycat just because I reproduced a geometrical shape!
ps. The site contains almost 200 images (maybe more) with all kind of prisms!!! Pyramids cubes etc!!! You cannot accuse everyone here for having a prism into his logo! Prism are not something to be declared as a under copyright protection drawing!!!!

Ok, so you say you didn't copy the photo, but just the idea... Then why didn't you change the angle? you kept it exactly like the photo, why? If you was just using the idea you could of manipulated it any way you wanted, but you didn't you kept it exactly the same as the photo. You might of as well just traced it.

It is a different angle! I made it step by step by watching the photo and not by tracing it! Also StockLogos didnt removed my logos.
Also why try to make it different? The guy who made that image is not the inventor of that kind of prism for Christ sake. Its like trying to make a different angle for pyramids of Giza!

Actually, that stills happens. I had a diamond removed because it was too close to ones on the net – diamonds are made of geometric shapes but ... goodbye logo.

These things would not happen as long as our proposals would be hidden until finishing brief time allotted.
Actually, they would still happen. Heaven and angel wings are synonymous; as are shopping and shopping bags.
In fact, we'd probably see even more similar logos. A lot of designers try to stay away from being too similar, even if they had the same idea. (If I see a concept in mind, I look to see what has been uploaded for the brief, and just go "oh, hell" if I see something too similar. Then I think of another concept).

There's over a dozen and they all look like "live trace" & Photoshop "cutout" filter. Unless author went to all these locations and took the photographs they traced from?
It's possible he's a photographer trying to get something out of his overabundant lighthouse pictures.
I have photos from New England, Wyoming, California, New Mexico, Texas and many other places in my own portfolio.
I would be leery of using a recognizable building, though. I don't think Nubble Light would like to see their image being used as someone's logo.
I am not sure but image trace must be a violation.
I'm not sure about that, unless it's privately-owned. I'm guessing that if the designer owns the original photos, they're probably OK. I was suspicious myself and did an image search of a couple of them, which came up empty.
Perhaps Ivan must ask for the original images before publishing especially when its obviously a trace!!!

You can't just make accusations. If you are claiming somebody traced a logo, you need to link to the logo.

Even though it is not the exact same shape, the easy recognition (overall shape and colors) could be a problem for a potential buyer who would like to trademark this logo. The "Interstate" shield was trademarked in 1967:

It's trademarked for shape and colors. If this logo is bought it would be very hard to trademark and/or the buyer will have problems with the American Association of State Highway and Transportation.

Different enough in my opinion. I like your logo btw.
If I was site admin, I would remove the union logo. What is the significance of having both logos on the site ? The first one (union) uses the same shapes and concept of Applex's one, so ask yourself how would you feel if you was Applex and union logo sold tomorrow.

Hard call, because yours have necks, these don't.
The concept of having people in a circle holding hands is not unique, nor is having a circle for a head, and some sort of shape to represent arms.
So, I would be inclined to say the other one is safe, less people, no necks, different colours.
Yours is much more attractive though.

You really need to put up an entry requirement of some sort. It would be less work than approving, deleting, selling, deleting, refunding...
